YOUR FAMILY, YOUR PRIORITIES

Start with the people and decisions that matter.

Estate planning can involve both passing on wealth and arranging support if you can no longer make decisions.

01

Who do you want to provide for?

Consider the people and causes that matter to you, their needs and the financial resources available.

02

How is your wealth held?

Super, personally owned assets, jointly owned property and family trusts may need different arrangements.

03

What has changed?

A relationship change, inheritance, business sale or move into retirement can be a useful time to revisit your plans.

CONNECTING THE FINANCIAL DETAILS

Bring the separate parts into view.

We help identify financial considerations and coordinate with the professionals responsible for legal and tax advice.

01

Assets and ownership

Build a picture of your investments, super, property, business interests and debts, including how each is held.

02

Superannuation nominations

Review beneficiary nominations and available options in the context of your fund’s rules and your family circumstances. Your Will does not automatically deal with your super.

03

Wills and testamentary trusts

Consider the financial questions to raise with your solicitor about your Will and any proposed testamentary trust. Your solicitor advises on the legal structure and prepares the documents.

04

Family trust and business succession

Coordinate financial planning with your solicitor and accountant when considering future control of a trust or business. The governing documents and ownership arrangements matter.

PLANNING AHEAD

Make the practical arrangements part of the conversation.

A useful plan also considers who may need to act and what information they will need.

01

Decision-making support

Discuss enduring powers of attorney and other relevant documents with your solicitor. The available arrangements and their operation depend on the applicable law and your circumstances.

02

Family financial needs

Consider access to funds, ongoing expenses and the different needs of the people you want to support.

03

Professional coordination

With your permission, involve your existing solicitor and accountant so financial recommendations can be considered alongside their advice.

04

Reviewing after change

Revisit the financial arrangements when your family, assets or goals change. Legal documents and nominations may also need separate review.

CLEAR PROFESSIONAL ROLES

Legal documents need legal advice.

Willow Wealth Partners provides financial advice and estate planning coordination. We do not provide legal advice or prepare Wills, powers of attorney or trust documents.

Estate outcomes depend on the law, ownership, valid documents and your circumstances. No arrangement can be assumed to prevent disputes, eliminate tax or guarantee that every asset passes as intended.

HOW ADVICE WORKS

A clear process, with room for your questions.

We begin with your priorities and existing arrangements. If advice is suitable, we explain the proposed work and fees before you decide whether to proceed. Any ongoing service is agreed separately.

01

Understand your priorities and current position

02

Agree the advice scope and fees

03

Explain your options and the practical next steps

COMMON QUESTIONS

Questions about estate planning.

Your financial adviser, solicitor and accountant may each have a part to play.

01

Does my Will cover all my assets?

Not necessarily. Superannuation, trust assets and some jointly owned assets may be dealt with differently. Your solicitor can explain the legal position, while we consider how the financial arrangements fit together.

02

How does a binding super nomination work?

A valid binding nomination directs the trustee to pay eligible beneficiaries or your legal personal representative, subject to the relevant law and fund rules. Requirements and expiry arrangements vary, so the details need to be checked.

03

Can you work with my existing solicitor?

Yes. We can coordinate the financial planning aspects with your solicitor and accountant, with your permission. You remain free to choose the professionals you work with.

04

Is a testamentary trust right for my family?

It depends on your wishes, the beneficiaries’ circumstances, costs and ongoing administration. A solicitor can advise on legal suitability and drafting, with your accountant considering tax consequences. We consider its place in your wider financial plan.
